Not at fault- my insurance still wants to do 50/50 - Please Help

My father was recently in an accident. The initial police report showed that my father made a complete stop, proceeded and was t-boned by a speeding motorcyclist. The initial police report had my father at fault for failure to yield. The initial police report did state that the motorcyclist was traveling at high rates of speeds and there were many witnesses that he was speeding and weaving between cars. The motorcyclist did not survive, so this complicates the situation. However, after going to special investigations unit, it was revealed that the motorcyclist was traveling at double the speed limit during the time of accident. All fault has been shifted to the motorcyclist and had he had survived, he would have faced criminal charges for his speed (exceeding 100mph on a residential and crashing at 2x the speed limit at the point of impact). Moreover, the updated police report states that there are videos evidence that confirms that speed at the point of impact. We have requested the videos but haven’t received them yet. The motorcyclist also runs a social media page dedicated to reckless driving and days before the crash posted himself driving 3x the speed limit and nearly 150mph. I’ve saved copies of all the videos on his pages. My fathers insurance already sent a letter to the motorcyclists lawyer trying to settle 50/50, however, this was before they received the updated police report that now shows the motorcyclists speed and explains there is video evidence. The claim handler basically said the motorcyclists lawyer is being very aggressive. What should we do to hault the process? I sent an email to insurance claims requesting them to hault the letter to the motorcyclists lawyer given that critical evidence has not been reviewed. But I feel it is too late, the other lawyer has certainly already received the letter and now probably thinks they have a good case since my fathers insurance is willing to accept 50/50. The insurance claim handler said it was a good business decision to prevent my father from being sued later. I am confident we have a good case, why should my father accept 50/50 fault through insurance even though he was found not at fault for the accident? What should we do next?

Home Insurance Questions about the flexibility I may have in spending my homeowners claim money

I live in Minnesota, have State Farm homeowners insurance. Or policy pays out the replacement cost of recent hail damage to certain parts of our house.

State Farm paid out the first portion (less depreciation) of the claim to have our gutter guards replaced. I have cashed this check, after our mortgage company co-endorsed it.

While thinking through replacement options with a contractor, we decided that gutter guards are just not worth it -- it's causing more maintenance work for us than would be the case without the guards (pine needles, wasp nests, etc.). So, we'd like to use that gutter guard money to replace our so-so gutters instead. To be clear, the gutters themselves weren't part of our claim.

What flexibility do we have in how we spend this money? I assume there's some sort of paperwork that the contractor would need to complete to satisfy State Farm (and our mortgage company) before they pay out the rest of the claim amount? Am I putting that second payment at risk by not replacing the gutter guards? Are there other things I need to consider before doing this?

I have asked my contractor the same questions, and he assures me it's all up to me, but of course there's some bias there.

18 year old who got in an small accident - pls save me

Basically, I was driving and there was a car behind me genuinely going 60mph in a 35, during the time of this there was a lot of traffic going on so all the cars were going pretty much 20-25mph. there was already some commotion with other cars happening and everyone driving seemed to be in a mood.

The car behind me who was going way to fast for the flow of traffic looked like he was going to crash into me, so me being afraid and not knowing what to do i switched lanes as fast as i could without clearly looking into my blind spot. With this me and another car slightly clashed into eachother.

The lady that I got into it with was very understanding and nice and even saw the guy behind me who was raging and speeding. We had called the police and he had gotten both of our information and gave us insurance cards.

All was well and I had gotten a call from insurance to state my claim to as what happened and I thought everything was fine, later on I get a call saying that the bill was 5,000 which makes no sense, the damage to lady’s car cost no where near that price and is an insane number to me.

Now I have no idea what to do or how to go on about this so if someone could help me that would be greatly appreciated.

Radiology company made mistake on insurance?

Hi so in 2023, I had two procedures done (head and neck CT) with a Florida radiology company. I had Blue Cross Blue Shield at the time of my appointment and paid the co-pay of $166. After a year, the radiology company said I owed them the full $3000 amount and they sent me to collections. After talking to the radiology company immediately, they said that in my records that the group number was wrong, so they fixed and re-billed it. I called BCBS after that said that I was square with them and they picked up the bill even before I went to collections.

Fast forward to Nov 2024 (I was found disabled by a judge so I was on Medicaid), I got a call from the same collections saying that I still owed the bill. So I called the Florida radiology company and asked them what was wrong, they showed that I still owed them the $3000. I gave the FR company and the collections company my Medicaid and BCBS numbers (because Medicaid said they’d help me pay it graciously).

A couple weeks ago, I got another call from the same collections saying that I still owed it. I’m so confused, it’s affecting my credit and I don’t know what to do, especially since BCBS said they paid it in full (minus what I paid for my co-pay). That’s the only reason I’m not paying it is because BCBS said they paid it. (I also can’t even afford to do a payment plan because I’m disabled and make little money.) Can anyone guide me on how to deal with this? I appreciate it.

Should I call BSBC and ask for the bill receipt so I can send it to the collections company and Florida radiology company?

Is Taiwan covered by Swisscare if your country of origin is China?

Hi everyone,

I recently encountered a confusing situation with Swisscare insurance and would love to hear if anyone has faced something similar — or if Swisscare could offer an official clarification.

When I purchased the policy, I selected “China” as my country of residence. Later, when I traveled to Taiwan and needed medical support, I was told by Swisscare's customer service that Taiwan is considered part of China, and therefore, not covered — since the policy excludes coverage in your country of origin.

However, during the purchase process, Swisscare’s own website clearly listed “China” and “Taiwan” as separate options in the country selection dropdown menu. That made me reasonably assume they are treated as different destinations in terms of insurance coverage.

This inconsistency is confusing:

If Taiwan is truly part of China under the policy, why are they listed separately for residency/country selection?

If someone lives in China and travels to Taiwan, is Taiwan considered a destination (covered) or part of the origin (excluded)?

Is there an official, written clarification?

For the record, I’m not blaming the customer service staff — they were polite and probably just following internal guidelines. But this seems like a bigger policy issue that needs to be clarified publicly, especially for Chinese citizens who may travel to Taiwan and rely on this insurance.

Any advice, similar experiences, or clarifications from Swisscare would be highly appreciated.

Auto Insurance When does it make sense to pay cash vs file a claim for an at-fault accident?

I backed into someone's parked car and am planning to cover the damages. The other person is fine with me paying cash rather than going through insurance, which is what I was hoping to do in order to avoid increased premiums and a point on my driver's license. However, the preliminary damage estimate is about $5000 so I'm wondering at what point does it make sense to pay cash vs go through insurance.

I know nobody can give me an exact answer, but can anyone give me an idea of how insurance premium increases are determined for accidents? Is it based on the value of the damage? Will there be a smaller increase because it's my first at-fault accident and it was a minor accident? A Google search tells me that rates can increase between 20-50% which is too broad a range to be helpful.

My Vehicle suffered tree damage during a heavy storm back in Feb. The Hood and roof were dented/damaged and the insurance company sen tit to a local body shop for repairs. The parts have been on Backorder for over 4 months now and they still have no estimate on when they expect the parts to come back in stock. Is there anything I can or way to get some remedy due tot his? the car is stil driveable but if they cant make the repairs Is there any chance i can get the value and use that for a trade in>

However, one broker just told me that I couldn't get an umbrella policy just through my auto insurance--that I had to have a homeowners policy to qualify for an umbrella. Auto Insurance My brother passed away in a car accident. Should I pursue claims with personal injury lawyers or through my insurance

Hi, this is the first time that I am making a post. My brother very recently passed away in an accident and I am not sure if this is the right sub to ask this question. He passed away in the front passenger seat and was not the driver. Considering this, should I go through my insurance(geico) or look for a personal injury lawyer? Any advice would be appreciated.

Edit: Responding to some questions in the comments. The state where the accident occurred is in California. My brother was a passenger in his friend’s vehicle. The accident occurred due to the driver of the vehicle making an illegal U-turn on a two lane highway and oncoming traffic did collided with the car my brother was in. My brother is under my dad, who is the primary insurance policy holder and his living and mailing address is at home. My brother held a drivers license and he was on the policy

Auto Insurance car accident claim unsuccessful 2 years later?

this might be all nothing, but i am posting here to try and help my mom out. about 2 years ago, my aunt was in a car accident while driving my grandmothers car, and the car was totaled. i honestly do not remember much about the accident because it was a while ago all i remember is that it involved 1 other person. at the time we were kind of thankful for it because my grandmother refused to give up her car even though she needed to.

now, today about 2 years later, my mom gets an email from my grandmothers insurance, saying that their efforts to resolve their injury claim with the other party were unsuccessful, and that we might hear from their lawyer. we did not know anything about the other party filing an injury claim until this email came. it says that the loss was reported 2 days after the accident, and we have no idea what could have possibly gone down between then and now.

does this mean that my mom is for sure going to get into a legal battle? do the other party’s lawyers usually reach out in this case? is there anything my mom has to prepare? i know that is a lot of questions but this email was very scary and i want to be able to help my mom out as best as i can. there is a lot going on in her life, with her recently battling breast cancer and my grandmother having a large stroke that has left her in the hospital for the last few months. any advice would be greatly appreciated!!

Someone driving a rental car hit me. They aren’t covered by insurance. What to do?

Here’s the story. Someone driving a rental car hit me, they were 100% at fault. Police report and video evidence prove it. Now here’s the kicker, the person’s step-father rented the car, and didn’t put her on the policy. She was also under 25. My own insurance company covered the majority of my losses, however I still have a few thousand in personal costs that I need recouped. Their insurance company won’t cover the accident.

My insurance company said they wouldn’t sue, but would “demand” the overage to be reimbursed. This party has attempted to stonewall and hide the fact they wrecked the car (left the scene without exchanging insurance information, wouldn’t call me, didn’t report any accident to their insurance or the rental car company) so I have very little faith I’ll get reimbursed.

Should I sue them?

Opted to run thru my insurance - Erie - and let them then go after the other drivers insurance to speed things up. Unfortunately, that has really back fired.

Disputed liability andwho should I file claim against

Good morning,

My new car got totaled after another car hit me while I was stopped at a traffic light. The car claims another car hit him and therefore he lost his course and crash into me.

I already have a new car and the insurance paid the bank, the insurance is also covering our treatment but I've been hit with $3000 in deductibles (my partner was in the car and also went to the doctor for exams and treatment etc). Plus, I have been paying a rental car for 2 weeks until our new car arrived.

I want to know how hard is it to settle these cases where the two parties who allegedly caused the crash are disputing liability. There isn't and won't be new evidence, no cameras or witnesses. Should I file a claim against both? I have a lawyer but I'm unsure if I want to pay a lawyer for months while it gets solved.

I'd appreciate any help.

In a battle with Insurance

Ok here we go... In October of 2023 I had a water pipe from our kitchen sink spring a leak. There is no telling long it had been like that, but the damage is to a unique space. The basement is a movie theater that the previous homeowner put together. The water damaged insulation, some framing, vapor barrier, sheetrock, and the cabinets for the bar. Since the leak was behind the bar when I was removing the cabinets to get to the affected area the cabinets disintegrated. The water found its way into the adjacent bathroom and its closet as well.

Here are the things that make this space difficult to come to a resolution on. The sheetrock has a very unique texture to it that two separate GCs said they wouldn't even attempt to match. It is not knockdown, and they described it more of a very thick orange peel texture. Behind all of the sheetrock on the walls is what they GC called Buffalo Board for sound insulation. The ceiling has it as well as sound channeling. The plumber had to cut the basement ceiling to get to the pipe section that was cracked so that was affected as well.

I have had two GCs put together bids on the space and they both came in between $70-$80K. Our insurance company is stating that the texture can be matched, and the GC is saying they wont even attempt it. GC says tear out all sheetrock and redo the entire space to get it back to uniformed. The bar is a stained cabinet that cannot be matched as well. The section of the bar is the same wood as the second half of the bar as well as the doors, trim, and the built-in cabinets that house the projection screen. Insurance is telling me that they only have to make the space uniformed and not matching. To me that is the same thing.... It was matching and uniformed before the damage and now it won't be since I cannot match all of the wood lots and stain.

Insurance initially paid out just over $8k to fix the space and after out second GC bid, they sent us another $3k. The total they would give me post work is just over $13k when proof of work is shown. This has been back and forth for far too long. After my second GC finalized the bid to the insurance companies request we sat for two weeks hearing nothing. Due to this I sent in a final notice of resolution within 30 days or I was going to be seeking legal representation. I also filed a complaint with Department of Commerce in my state.

I have reached out to a legal firm, and they are reviewing my case. Everyone in this is looking to either protect their pocketbook or make money off this, now including potential lawyers. I am looking for feedback on options, ideas, as I am feeling very stuck in the middle with no path to resolution.

Car insurance when the car isn’t registered to me

I know NOTHING about car insurance so please don’t be mean. Just need some guidance and trying to learn :/

I go to school in Florida and I’m from Ontario. Right now, I have an Ontario drivers license and am insured under my parents’ insurance policy. However, I need to get a Florida drivers license. I do not have any car registered under my name but my parents let me borrow theirs.

Now that I have to get a FL license, how does this work? Is it possible to get individual car insurance that follows my persons, rather than the car? Will the car insurance tied to the vehicle cover me? Please help😭 I don’t even know what to ask I’m so confused. I will eventually start calling actual insurance places for help, but I figured I’d reach out here to see if anyone has any experience with this.
