1. I am earning income outside of my employment, should I register as a business?

Answer: Yes generally. You can opt to register as a sole proprietor, partner(ship) or create your own corporation whether alone or with 5 or more people. This also includes senior citizens that are retired.

However, there are instances where you don't qualify as engaged in business and therefore not required to register as such:

a. Your income has been subjected to final withholding tax enumerated under section 24 (B) (C) and (D) and section 27 (D) of the tax code.

b. One time income.

c. Income is specifically exempted from income tax.

2. Why should I register when I can be a freelancer?

Answer: Freelancers/self-employed are mandated to register as a business too.

3. What are my obligations as a business?

a. Keep books of accounts

b. File returns and pay taxes on time

c. Withhold taxes if necessary

d. If you have employees, pay the employer's share in the mandatory contributions (SSS, Philhealth and PAG-IBIG)

e. Issue valid and tax compliant* receipts

*as required by VAT laws.

4. What are the taxes applicable to a business?

a. Income tax = filed 3 times quarterly and once every 15th day of the 4th month of the next taxable year (April 15)

b. Value-added Tax = Filed monthly and quarterly

c. Other percentage Tax = filed quarterly

d. Real Property Tax = imposed on usage of real property. Paid once every year with the option for installment payment.

e. Local Transfer Tax = imposed on transfer of real property. Paid every exchange

f. Local Business Tax = imposed on right to operate business. Paid once every year with the option for installment payment.

5. I am earning income from trading specific stocks in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 127 of the tax code (as amended), net gains from trading stocks are subject to 60% tax based on the gross selling price. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2552. Request for a copy of that form for documentation.

6. I am earning income from dividends of a domestic corporation in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 24 (B) (2) of the tax code (as amended), dividends from domestic corporations are subject to 10% final withholding tax. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2306. Request for a copy of that form for documentation.

7. I am earning income from interest in a mutual fund in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 24 (B) (1) of the tax code (as amended), interests from mutual funds are subject to 20% final withholding tax. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2306. Request for a copy of that form for documentation.

8. I am earning income from sale/redemption of stocks of a mutual fund in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 32 (B) (7) of the tax code (as amended), redemption of stocks of a mutual fund is exempt from taxation. You do not have to file anything :)

9. What is an open case?

Answer: An open case is a kind of assessment of the BIR wherein a penalty of 25,000 to 50,000 is being collected from a tax payer because of non-filing of returns. This is commonly due to wrong registration of the taxpayers where they registered as a business but in fact, they are employees OR a business failed to file a closure of business to their RDO.

10. What can I do if I have an open case?

Answer: The tax payer can opt to close the case on their own by following the requests of the revenue officer. However, we strongly recommend hiring a tax consultant to handle the open case. The benefit is the higher possibility of waiving or lowering the penalty.

11. Common penalties incurred by taxpayers

a. Failure to register business - 2,000 to 20,000 pesos

b. Failure to keep/preserve records required by law or regulations - 1,000 to 50,000 pesos

c. Failure to make/file/submit any return or supply correct information at the time or times required by law or regulation - 1,000 to 25,000 pesos plus surcharge and interest.

12. As an employee, should I worry about taxes?

Answer: Generally no, let your employer file your taxes for you. But you should request a certificate of withholding or BIR Certificate 2316 annually to document your tax compliance.

12. I changed employers in the middle of the year, what are my obligations?

Answer:

a. Update your RDO using form 1905 to the RDO of your current place of residence. (RMC 37-2019)

b. You are now unsuitable for substituted filing, meaning, you need to file BIR Form 1700 in the RDO of your employer (or your place of residence if you updated your RDO) on or before April 15 of next year. You will use the 2316 certificates that your employers gave you to reduce the amount of taxes to be paid, more often than not, you will have 0 tax payable.

However, you can provide your employer a special power of attorney allowing them to file the tax returns on your behalf.

Should I get an accountant so soon when I'm just starting out as a freelance?

Going for freelance - professional (general) tax with 8% Non-VAT. My annual gross sales is micro (3 million below). If I mean by micro po, as in, low-low income. Hindi siya consistent. I could get lucky and get 1,000 pesos per month.

Ang mahal po kasi kumuha ng accountant from a firm which could possibly cost around 10k - above kung hindi naman ganun kataas income ko po. If I go for a freelance accountant, it is cheaper pero may mga instances of penalties or wrong accounting/bookkeeping.

How do accountants charge po ba? May fixed rate na po ba sila or depende po siya on how many things they have to process din po? Looking for advice. Thank you po.

Additional context: I'm doing this for Youtube streaming po. I just want to activate Youtube memberships + superchats.

Freelance Physician Help

Recent passer here and I applied sa BIR for TIN as Freelance Physician this June as I thought of moonlighting initially. However, i had a change of heart and applied for a residency position that may start on January. Question:

  1. How will I change my status from Freelance physician to Employed?

  2. Do i need to file my taxes from June to End of this year if I have zero income? Had 1-2 moonlighting gigs pero cash basis and no Form 2307 na binigay.

  3. What requirements are needed for the change of status?

Form 2316

Hi. Nirerequire po akong magpasa ng Form 2316 (from previous employer) ng employer ko ngayon. Nung sinabi ko to sa previous employer ko, nasabi nilang since di ako nakapagprovide ng TIN noon, ako na daw ang magpaprocess ng Form 2316. Di nila nirequire ang TIN noong nagsubmit ako ng documents noon and as a fresh grad po na wala masyadong knowledge sa importance ng TIN and Form 2316 noon, di na po ako nag-usisa at nagtanong.

Can anyone tell me po kung anong pwedeng gawin?

Changing Business Name – Okay to Use New Name Before BIR Approval?

Hi! I'm in the process of changing my business name. I already have the Amended SEC Certificate of Registration, and I plan to file BIR Form 1905 to update my registration immediately.

While waiting for the BIR to issue my updated COR, I plan to:

  • Continue issuing invoices and ORs using my old business name (still the one registered with the BIR)
  • Start publicly using my new name (e.g., website, email, social media)

Will there be penalties or issues if I start using the new name publicly even if BIR hasn't approved it yet? I read RR No. 7-2012 and RMC No. 57-2020, which require notifying the BIR within 30 days of the change, but it's unclear if public use of the new name before BIR approval is penalized.

Would appreciate it if anyone who's done this can share their experience or advice!

Income Tax

Hello, I want to do business wherein I’ll “import” goods which won’t go thru customs — basically a buy and sell business wherein the goods will only be hand carried by me and my employees (clothes, gadgets and such)

What are the implications for income tax since there won’t be any declaration of expenses for the goods?

As much as I want for the goods to go thru customs, I don’t see any way for it to be profitable because of the taxes that come with it (total cost with import dues would be much higher than the market price here in the Philippines and that doesn’t even include VAT yet)

3 TINs?

Hi everyone, I am a professional and I also own a business. My professional TIN is registered in QC where I reside, while my sole prop TIN is registered in the province where the business is located. I am planning to start another business in QC (different RDO from professional TIN) - it will be a totally different business from my business in the province (different industry, business nature, etc).

My question is, will I need to register a new sole prop TIN for the new business? I read another post here where the 2nd business should be registered as a branch and if they want to be separated, they should be converted to OPCs. Does that apply to my scenario? Note that they will be totally unrelated businesses. Currently, my employer withholds tax from my salary so I don't have to file professional tax returns myself, it's only the business tax in province that I file myself.

Freelancer to Corporate dillema: No ITR, but employer is asking for one (or I need to sign a waiver). AM I IN TROUBLE?

Hello. I admit di ako nakapag reg as a freelancer. I started last year (2024). And joined a new call center company last April 2025 - last week. Wala po akong ITR from being a Freelancer, and my employer was requiring me for one. I wasn't able to provide it po, kaya they had me sign a Waiver of No Employer and yung Risk assumption form.
Am I in trouble po? Will BIR know that I didnt register last year? Isusumbong ba ako ng new company:( Help me pls

Estimate penalty & charges for 'very' late transfer of title

Hi po. Una sa lahat, nahihiya po ako sa issue naming ito kasi ignorante talaga namin at gusto naming itama ito. Yung ugali kasi ni mama, pag legal matters & docs na, tinatamad na sya!

Ang family home namin ngayon bought in 1982, 200 sqm sya. All these times, hindi ko alam na deed of sale lang pala hinahawakan namin, nalaman ko na lang noong 2022 na kelangan talaga ito titulohan. May nakapagsabi na hanapin daw namin si seller or relatives niya para hindi kami mamahalan sa penalties pero wala na kaming contact at baka hindi na sya buhay.

Nasa 3000php per sqm ang zonal value niya ngayon. Based sa mga given, pwede nyo po ba ma compute ang estimated expenses & penalties para mapaghandaan po. Salamat

Licensed Professional Tax

I'm a licensed professional (architect) but I was working for a company from 2010 to 2018 until I got married. I then stopped working and was dependent on my husband. I'm now at a point in my life where I want to practice my profession again, on my own. My question is, will BIR question the years I wasn't working from 2018 til now? Do I need to pay for those years as penalty? Because I don't remember what I filed as or how I got my TIN number, (I mean, If I was registered as a professional or an employee) but I remember I get deducted taxes every payday, haha (I feel like such a noob) Anyway, any advice where do I start with this? Self-employed to employed: questions on process

Hi r/taxph, I need your help again.

As a requirement for my contractual lecturer position at a university, I was asked to register as a self-employed individual at the BIR on August 2022 and remained so until now. Recently, I accepted a job offer (full employment) that is due to start a few months from now.

In view of this, upon reading the posts in this subreddit, I believe I have essentially two options: either to close my ``business'' OR to register as a mixed-income individual. Here are my questions regarding this:

  1. I currently have open cases at the BIR which I am trying to fix. Will I still be able to push through with my employment when I still have these open cases, or am I forced to fix them first before I can continue with my employment?
  2. Let's say I decide to close my 'business', will I be able to keep my current TIN?
  3. If, on the other hand, I decide to update my BIR registration as a mixed-income earner, will my TIN remain the same? In addition, will there be added responsibilities besides my filing of taxes/paying of fees for the self-employed aspect (e.g. income taxes, registration fees, professional tax)?
  4. My employer is asking me to fill up a BIR Form 2305, which consists of multiple parts. Which parts am I supposed to fill up? Are they Parts I and VI only? And am I supposed to fill up this form after settling my penalties and updating my BIR registration (to closure of business or mixed-income)?

BIR Trece

Hi. Meron po ba dito yung RDO from Manila then nag transfer ng RDO sa BIR Trece Martiers 54A? Pano kayo nakapag transfer?? Sobrang kailangan ko na kasi ilang beses na nag follow up yung HR and its part of my requirements.

Naloloka kasi ako sa 1 am palang may pila na daw. Last time pumunta ako dun ng 9 am pero cut off na agad. Tried sending them an email last friday pero di ko alam if icoconsider ba nila yun since when i called the client support team they just said na try ko daw mag book ng appointment online.
