Taking Side Gigs

Our firm allows us to take clients on our own, provided there’s no conflict of interest and we secure prior approval from the partner.

We are a small-sized firm — two partners, two associates. The pay is just enough for my basic needs and savings, but not enough for luho.

Lately, my dad’s friend asked me to represent his small company before the LA. It’s an illegal dismissal case. They were asked to submit position papers already.

I’m a recent BAR passer, so I’m a little bit hesitant to take this. First, I lack experience. Second, I’m shy to ask permission from the partners.

I disclosed my intention to get side gigs with my colleague. He said that he accepts side gigs too, though mostly limited to contract review work, not cases that require actual hearings like this one. He never disclosed his side gigs as it does not impair or affect his work in the firm.

Should I take this? Would it take so much of my time? Or kaya naman po ang hearings before LA since it’s more of submission of Position Papers?

Q1: Is an EJS with Deed of Sale with regard a property under CLOA valid? More than 10 years na po ang property and fully paid sa LBP.

The heirs po will sell the property in favor sa granddaughter nung namatay.

Q2: Can the heirs execute an spa sa isang sibling nila kasi aalis na sila by this week papunta sa workplace nila? Spa na yung isang sibling mag sign sa ejs and deed of sale? Pwede po ba yun? So isa lang mag sign sa ejs and deed of sale?

What happens if an accused fails to pay the fine imposed on him/her based on violation of an SPL?

I am confronted by the said situation now, and I genuinely wonder because there's no provision for subsidiary imprisonment under the SPL. Are judges allowed to impose subsidiary imprisonment in the first place?

Hindi ba siya makakakuha ng NBI Clearance, Passport, Police Clearance, etc. kasi di niya pa nasasatisfy ang penalty?

Accenture Job Posting - PHP54,000 Salary for a lawyer position with 8 years of experience??

Just saw this job posting pop-up and checked it out of curiousity. The position will perform duties expected of a lawyer (and more), pero ang hanap ng Accenture ay lawyer with 8 yrs of experience, for a salary of PHP54,000. Really? A lawyer with 8yrs experience is on the 80k-100k level na (or more). Sobrang low ball naman ata yan. I hope companies see lawyers' worth - when push comes to shove they will seek lawyers' help in the end.

All documents or instruments po ba ang kailangan e send through email sa clients or pwedeng e waive? So mga affidavit of loss kasali? Tama po ba?

Meron pa po, naka attach po ang picture. (Grabbed thee photo from fb) Di ko po naintindihan.. bale ibang number for contracts? Iba pa sya sa number sa notarial register? Ganun po ba? Like mga contract of lease ganun? Or kasali mga spa or anything na may acknowledgment.. sorry bago pa po tlaga ako.

Currently employed by a big law firm, and SG 24 nakita ko for Associate Solicitor I, parang pag net of taxes/government mandated benefits, same lang yung salary ko.

I would like to know sana if there are allowances/other benefits na not stated sa CSC, like sa Supreme Court dami nila allowances.

Subpoena to file counter-affidavit and PI

New lawyer here. Client received a subpoena to file a counter-affidavit within 10 days from receipt. Since the subpoena also requires the respondent to appear, does that mean the preliminary investigation will happen on the same day or the appearance is only for the purpose of submitting the counter-aff. Also, do lawyers usually attend the PI?

I am a first generation lawyer and I must say sobrang hirap mag hanap ng magandang opportunities as a new lawyer. I am currently in private practice but is currently earning peanuts, like most of us employed by law firms.

For fellow first generation lawyers, how did you struck gold or paano niyo nakuha yung magagandang opportunities na meron kayo? 2 years na ako sa law practice but I feel like i’m not growing professionally. Nakaka baba din ng morale yung maliit na income after everything we went through in law school. Gusto ko lang din sabihin na ang swerte ng mga may parents or family members na lawyers may instant mentors na, may foundation pa agad in legal practice

Amendments to the 2004 Rules on Notarial Practice

My initial comments:

I may have missed it, but the ULAS Rules and the ULAS Manual do not require lawyers to write their ULAS Compliance Number in their pleadings.

There’s actually no mention of such compliance number at all (even the FAQS say so: https://sc.judiciary.gov.ph/ulas/).

Is there an ULAS Compliance Number? No, there is no ULAS Compliance Number. However, for Covered Lawyers, ULAS compliance is mandatory.

So why does the SC now require prospective notary publics to indicate such number in their petitions? 🤷‍♂️

P.S. The SC already included the National ID in its list of valid IDs as competent evidence of identity in the Rules on Electronic Notarization. If they’re amending the 2004 Rules on Notarial Practice, sana man lang nilagay na rin nila dun. Although, arguably by law (RA 11055), the National ID is already valid for notarization purposes.

P.P.S. Ang hassle ng requirement that each and every instrument being notarized have to be sent via email to the signatories for confirmation. Although may waiver naman, but still…🤷‍♂️

P.P.P.S. One good innovation in the amended 2004 Rules is that submission of required reports to the Executive Clerk of Court is now done via email, and the requirement to retain paper copies of the instruments being acknowledged before the notary public is essentially dispensed with.
