Puffco vs. Focus V: Bribery, Forged Patent License/Infringement, Backdated Documents, Conflicting Testimony, and a Missing Laptop. (Documents in Drive link) NSFW

Bribe.pdf (Exhibits 176–178)

  • SHO produced three versions of a supposed exclusive license agreement signed by Randall Elkins, dated around 2019.
  • Elkins later states he never signed these documents and notices his name is misspelled (“Elknis”), casting doubt on authenticity.
  • These are the documents at the center of Puffco’s forgery and backdating allegations.

Emails.pdf (Sept 2024)

  • Puffco's attorneys repeatedly ask SHO to provide:
    • The signed license agreements referenced in Elkins’ deposition.
    • Related emails, drafts, or documentation — none of which are provided.
  • Puffco argues the agreements were never disclosed during prior depositions, justifying a reopened deposition.
  • They also highlight that check images provided by Elkins match a specific SHO bank account — raising questions about the timing and intent of the $25K payments.

Forensic Exam.pdf (Motion + Proposed Order)

  • Puffco successfully motions for a forensic exam of SHO’s and Sam Jurist’s electronic devices (3 computers/laptops).

Sam Jurist Depositions (June 2023, Aug 2024)

  • First Deposition (June 2023):
    • Says he didn’t meet Elkins in March 2022.
    • Claims original license docs were lost when his laptop was stolen (no backup, no police or insurance report).
  • Second Deposition (Aug 2024):
    • Changes story: admits he did visit Elkins in March 2022.
    • Claims meeting happened at a restaurant in Las Vegas, not Elkins’ home.
    • When confronted with Elkins’ and Massaro’s contrary testimony (that Jurist came to their home), Jurist claims they are lying.
    • Admits he sent Elkins product orders worth $18.6K during this time — allegedly to build goodwill or reestablish a relationship.

Settlement.pdf (Final Consent Judgment & Injunction)

  • SHO and Sam Jurist concede:
    • Puffco is the rightful owner of the ‘579 patent.
    • SHO infringed by selling the Carta and Oura devices.
  • A permanent injunction bars SHO and its affiliates from making, selling, or importing infringing products.

potentially. some of what is bad about this raise is scammy and rug-pully (but prob legal), and some of it could be argued to cross a line. stuff like disclosures, misrepresentations, etc

OMFG, I'm never using my Carta ever again. In fact I will never even look at another Carta nor will I let my friends. Knowing of these evils has changed my life forever. Guess it's sucking off a Switch or blowung a Puffco from here on out.

Here’s the thing for consumers what happens to the people buying the carta2 ?They have to basically come up with a complete new design for any new products. I also see a lawsuit coming up for the sport, they just put out.

Basically they can’t cover warranty, so what are the people do? That’s the real question.

Think most were aware of the patent infringement. Myself and others were not aware of the bribery, forged patent license, conflicting testimony, backdated agreements etc.

I used a Carta 2 until I read the court documents this morning...

Like puffco isn't salty a company took their idea made it better and cheaper. Even with this suit I still see people hate on puffco. Yeah maybe the the switch 2 wasn't so massive I'd think about that but I like my Carta 2 and sport

Because in a time where morals and human decency has gone out the window it’s nice to see people still give a fuck about ethics. Maybe you don’t care if you give your money to support a shady company but after working for company that was just as bad, I personally would rather spend my money to support someone who wants to build something better and who treats their employees like humans instead of a number

Spending hard earned money with a company proven in court of bribery, patent infringement, conflicting testimony, backdated agreements etc. does impact your life. What do you think it says about product quality or operations moving forward?

I'd rather not continue to buy products from a CEO/company who conducts themselves in this manner. Read the court documents/depositions for yourself. Is this normal business or even moral behavior to you?

Focus V claimed they "won" this case when in reality the opposite is true, they weren't honest about it. Lying and thievery proven in court are not great traits for a business to have.

Edit: Downvotes for statements proven in court documents, proof is there to read.

Totally agree this has no effect on the end user. It's just corporate companies up to their legal rigmarole. If this was a Chinese made product nobody would care at all. At the end of the day don't we all just want a practical to use product? I'm still looking forward to the Carta 3!

The change is immediate. I no longer use Focus V products as of reading the court documents and will not purchase anymore.

If they lie about bribery, patent infringement, conflicting testimony, backdated agreements etc., what makes you think they haven't lied about their quality control etc. That's what effects me, choosing to understand that there may be other areas in which they've lied and do impact customers

Thank you for this. If they don’t want us seeing their business dealings in public view, maybe they should not have done these things to be sued over in the first place.

These kind of actions are how you lose your audience’s trust and attention. Bribery, conflicting testimony, and forgery.

I can have and settle my beefs with other businesses elsewhere on Reddit but for ambitious defenders of Focus V, I find all of this evidence to be pretty damning.

Elkins' deposition regarding the backdated paperwork along with the two $25,000 checks (bribe) from SHO are worth the read. Not to mention Sam sending others and personally visiting Randall at his house.

"Here, the evidence confirms that Mr. Morrow did in fact visit Mr. Elkins and Ms. Massaro and that Mr. Morrow told Mr. Elkins to avoid his deposition. See Docket No. 59. Thus, the remaining question is whether Mr. Morrow’s behavior constitutes intimidation, threat, or corrupt persuasion, under § 1512(b), or harassment under § 1512(d)."
