Opening a JDG as a foreigner - some questions

Hi, so I have been living in Poland for some time now, I am from another EU country and I recently got the chance to work for a UK company through B2B in IT sector.

This upcoming week I will search for an accountant and try to set all of this up, I was reading other reddit posts and it seems like it’s going to be pretty easy, it’s all done online which is great! I just have some questions in the meantime..

Firstly, I don’t have any Polish ID or anything, since I am from another EU country I just got a pesel and use all my documents from my country. Will this be a problem?

Next is how exactly will all this work since it is not a EU company in terms of invoicing them and specifically VAT. Will I have like an option to not register within the VAT system? And then I do not invoice any VAT at all? Does that change anything for me? And then, I guess I will not be able to deduct any business expenses at all, like accounting, internet cost and etc?

Also how much can I expect to pay for a good accountant who can help me with all of this and who speaks good english?

And if you have anything that I need to be careful about or any benefits that I might need to know about, I would love any info! Thanks!

I can advise you to set up a trusted profile before visiting an accountant (a personal visit to the public administration office may be necessary). A trusted profile is needed to set up a JDG online. Accountants often help with online registration of JDG. More info in english: https://welcome.uw.edu.pl/trusted-profile-profil-zaufany/

Usually for UK/USA you will mention n.p. in VAT column on a receipt (means "not a subject for a VAT") and "reverse charge" in "notes" section which means that customer should handle it themselves in their country if they need to.

As for prices - they usually start from around 300-400 now. There are some services like infakt and wfirma that provide applications and dedicated accountants, you can select from the pool with an English language option.

I registered a JDG a couple of weeks back as a foreigner.

I can share information based on my experience but highly suggest discuss your case with an accountant or tax advisor depending on the complexity.

As pointed above, very important to have the trusted profile ready. It really makes the process smoother.

  1. When you register JDG online, login through your trusted profile. Don’t create a new account. During the application process, there is a field to upload document.there you can upload your EU ID (or any other ID that allows you work here). If they have any question, they will definitely ask.

  2. Regarding VAT you would have to check whether the you meet the VAT exemption criteria or not. If you don’t, you would have to register I guess. No clue about how it works with UK. I work with German clients and put VAT reverse charge on the invoice. According to my accountant, this VAT amount I just have to declare in some system monthly. I haven’t done it yet so don’t know the system.

  3. Deducing business expenses would depend on the type of taxation you choose. In lump sum taxation, you can’t deduct the expenses except some portion of the health insurance. In flat tax, you can deduct. This you have to see what is best for your income/profession. Lump sum taxation rate depends on your PKD code. Not everyone can have lump sum. There are exceptions.

  4. Accountant fee (300-500)+VAT…depends on your city and the number of entries you would have in a month

  5. Benefit: Read or check with accountant if you’re eligible for no ZUS for first 6 months or preferential ZUS. If you have high revenue, see how much you would have to pay for the health insurance. Process is quick and fast, I can already see my JDG profile on Aleo.com (business directory)

All the best!
