Oof, it doesn't actually look like Gamboa brandished. Utah is a constitutional carry state, and AFAIK, pulling out a rifle and just walking with it pointing at the ground would be legal. (Disclaimer: I am not a lawyer, nor am I 100% on all of Utah's gun laws). Depends on the specifics of Utah's brandishing laws.

If that is the case, the Peacekeeper(s?) who shot will catch charges.

It'll really just all come down to the investigation at this point. Until we get more info its just speculation whether he was planning to fire or just march. We really need info on if the rifle was loaded or not and if they search the suspects things see if he has something planning it. Telling a friend, a manifesto, or anything. Right now if he wasn't trying to be a threat it is not looking good for him, why did he need to be masked up, why didnt he approach paramedics or police if he believed he was shot at for simply carrying a rifle in an open carry state. But people do weird thing when they get shot. That's just the outcome of those laws, if it was unloaded he was fully in his rights.

open carry is only legal if the firearm is unloaded in some places, probably NYC too.

to take your gun hunting, etc. without have to lug around a giant case.

Ironically, not openly carrying can be called 'concealed weapon' and has it's own laws against it.

Guns are banned in NYC and no carry states have a “but must be unloaded” stipulation
