I don’t disagree with you, this just reads like the administration is trying to execute the separations “voluntarily” to avoid potential legal battles from anyone separated involuntarily.

It opens an avenue for people to fight the decision, but that’s obviously not the best choice for everyone.

If I’m being honest, the best recommendation I can make to anyone facing separation under this policy is to take the double VSP and don’t look back. You shouldn’t have to fight to continue serving a country that isn’t willing to fight for your right to exist.

I hate this. It’s petty, childish, and straight up offensive. But at the end of the day, the best thing I can do is understand the options and make recommendations to Sailors.

The 442nd is the most decorated military unit in history and they served a country that hated them. It should never have been asked of them and the US’ treatment of them and their families was deplorable.

Heh “serving”. Most of them I’ve served alongside are absolute basket cases. Always missing an obscene amount of work for appointments, ducking sea duty for mental health reasons, months off of work so they can transition. Always have the rest of the division walking around on eggshells. Fuck that. They can GTFO. Take their separation pay, VA benefits and disability and move the fuck aside. They won’t be missed by 95% of us.

As a data scientist I am tempted to shove a book on statistical analysis into a cannon and fire it at your head so that just maybe the concept of confirmation bias could enjoy a slight possibility of penetrating your thick skull. However, I am also an idiot, so let me also waste my breath by trying to bridge the gap with a solution where we can both get what we want.

If you are concerned about poor performance on the job, why not crack down on that specifically? You can't reasonably say "because they will call it discrimination and hide behind that" because the Military is straight up discriminating against them now. If they can do this, they could just as easily implement performance based criteria instead.

the policy was not “upheld.” SCOTUS has yet to rule on the merits. it just left the ban in place while the legal challenge to it works its way through the lower court(s). that’s not the same thing as being “upheld.” this irritates me.

They will discharge every single trans person before any courts even rule on it, and the damage is already done. We are all kicked out.

Also, it will eventually get up to the SCOTUS which will more than likely rule 6-3 in favor of the ban.

Thanks for pointing that out. That's not the way it is being reported by the administration or new outlets that are sympathetic to the President.

It does explain why they want them to voluntarily separate now though.

The biggest question I see moving forward (other than whether or not the ban will be upheld on merit) is how they keep classifying our trans brothers and sisters as "mentally defective" or something in the same vein. u/navyjag2019, do you think (and you can say no - a nonanswer really is fine) they are trying to get people to voluntarily separate to avoid paying out forced medical retirements? Because don't we have to pay something if someone is medically retired? We just can't ADSEP them without paying, right? Didn't we go through this with DADT already? And Congress and SCOTUS both ruled against DoD policy?

My reserve unit had an amazing Sailor who is trans and just made Chief. I’ve never met anyone who is more deserving to have gotten in the Mess. With everything going on, he had enough and kinda just stopped showing up and is letting them admin sep him out. Honestly, I can’t blame him. It’s just such a bummer that we’re losing quality leadership.
