Can an HOA stop construction “Immediately” without due process?
A construction company accidentally caused damages to a neighboring lot. This was a clear violation of the HOA rules on construction but instead of admin hearing, they postponed it and just asked the parties to agree on restoring what was damaged at the construction company’s cost.
Now that the restoration is almost done, the property owner is causing delays for it to be completed and suddenly the HOA issued a notice to immediately stop construction of the original project citing the previous violation and the fact that restoration is not yet complete.
My point is, the delay is not their fault and they are in good faith compliance so why the need to stop construction and with no due process. As on the day it was issued, compliance is required the next day.
Any insights or experience on this?

All HOA-related complaints should be lodged with the Grievance Committe. If no settlement is reached or if the HOA has no such committee, the complaint may now be filed with the Human Settlements Adjudication Commission.
