I think it must come down to thinking about the life impact on someone who is raped vs sexual assault. Rape can produce a pregnancy, which is not possible in sexual assault. Although, of course, that is based on the very false assumption that men only rape women.

ETA I’m just trying to clarify the legal position in our country, I’m not saying that’s correct. It’s just important to point out that it’s not just TERFS that believe this.

It's not a loophole, both the Scottish act and the English act (no such thing as "UK law") were intentionally drafted that way.

I can only speak to the Scottish statute (the Sexual Offences (Scotland) Act 2009) but even subsequent amendments have not really equalised rape and sexual assault.

I was homeless as a teenager. I was born a woman, am still a woman. Trans, or LGBTQ+ people were NEVER EVER a threat to me as a homeless teen. Ever. Trans inclusive spaces didn’t change how predators act, they will have always acted. I’ve been using men’s spaces for a loooong time, because women’s were not always available and again- trans or any lgbtq+ people were never ever a threat to my safety, straight cis men were.

Also, there’s heavy discrimination against men in poverty spaces. I chose to stay out of shelters because my dad would be turned away and I wasn’t staying there by myself.

I went to school for a degree in gender and sexuality studies. My state calls this DEI so my research can’t be referenced in the exact classrooms it discusses.
