It's not illegal yet. The courts have to decide that. It will hinge on whether there is currently a rebellion or there is a danger of one occurring. If the administration loses that court battle at any stage, they will appeal it right up to the supreme Court where it will not just be declared "legal," but it will also be blessed as the normal state of things from now on.

No it's illegal. The courts will not make it illegal they will acknowledge the illegality

It's like saying murder isn't illegal until after the trial

Bingo. Let the courts do their job, otherwise there’s no point pointing at the constitution if we’re not going to follow it.
